Fatal Car Accidents in Michigan

Midland, MI – Woman & Child Killed in Truck Wreck on Saginaw RdAny car accident can quickly turn into a nightmare, but it's especially devastating to receive a call that your loved one has been killed in a crash. Tragically, Michigan has a higher-than-average fatality rate for motor vehicle-related incidents when compared to other states: in fact, there were more than 1,130 fatal traffic collisions over the last year alone.

Thankfully, there are steps you can take if your loved one dies in a car accident caused by another person's negligence. While these actions won't bring your loved one back, they can help you in the following days as you deal with uncertainty, stress, and financial difficulty.

First, it's essential to explore the laws and statutes surrounding wrongful death in Michigan. From there, retaining the services of an accident attorney is crucial. For instance, applying for and receiving survivor's loss benefits and filing a wrongful death claim are two key tasks that a Michigan car accident attorney can handle on your behalf.

And regardless of who caused the car accident in question, you might be entitled to apply for survivor's loss payments under Michigan no-fault insurance statutes. Personal injury protection (PIP) insurance, which is necessary for all motor vehicles registered in Michigan, pays survivors' loss payments. Those who cover the cost of the deceased's funeral are eligible for a share of this recompense.

Moreover, according to Michigan law, no-fault insurance entitles the surviving family members of the deceased to compensation similar to the amount they would have otherwise received from the decedent. These compensated no-fault benefits consist of the following:

  • Replacement services and support for up to three years at $20 per day.
  • Up to three years' worth of lost pay.
  • Coverage for any medical bills or costs incurred before your loved one's death (such as hospitalization for brain damage, broken bones, and other conditions).

To be eligible for these benefits, you must fill out and submit specific claim forms as quickly as possible. This is another reason why retaining qualified legal counsel is vital in the aftermath of a serious wreck that's caused injuries or a loved one's death.
