The National Highway Traffic Safety Administration reports that every 10–15 seconds, a vehicle accident occurs somewhere in the United States. Given the dismal national and Michigan-specific collision statistics, it is not surprising that car accidents are the largest source of personal injury litigation in today's courts.
Because of "no-fault" insurance, insurance companies in Michigan often do not investigate who was to blame in an accident. Recoverable in a lawsuit against the negligent party are both first-party benefits (monetary damages) and non-monetary losses (such as pain and suffering).
If you've been in a vehicle crash, even if you think your injuries are modest and the case is simple, you should still consult with an attorney. However, research has shown that plaintiffs whose counsel defends them actually earn greater settlements, so victims shouldn't let the cost of legal representation deter them from pursuing justice. The vast majority of personal injury lawyers take cases on a contingency fee basis.
Having legal counsel is a plus in many scenarios. Your attorney will handle all communications with your insurance company and any other involved parties. In order to identify who is at fault in an accident and why you should be reimbursed, your attorney will look into all of your legal alternatives. Witness interviews and data gathering are two components of this strategy.
