Our thoughts go out to those injured as a result of this collision.
A car crash can have a devastating impact on your life. Unfortunately, there are countless instances where people are harmed as a result of vehicle crashes in Michigan. In fact, motor vehicle collisions are one of the leading causes of accidental injuries and deaths statewide each year. After being hurt in a car crash, victims have the ability to file a personal injury claim against the responsible party.
Michigan's legal system utilizes a concept called "comparative negligence" when it comes to personal injury claims arising from accidents. This means that when you've suffered an injury and seek compensation, you will need to demonstrate that the other party was at least partially at fault for causing the accident.
However, the degree of your own fault plays a crucial role in determining your potential compensation. If you were found to be more than 50% responsible for the accident, you are barred from seeking non-economic damages such as pain and suffering, emotional distress, and loss of enjoyment of life.
Despite being partially responsible, you can still recover economic damages, such as lost wages and medical expenses that you face following your crash. It is important that you are able to prove your case was caused by the negligence of another driver so that you can maximize your recovery. Working with a Michigan car accident lawyer will help to ensure you have the strongest evidence for your case.
