Premises Liability in Michigan

Premises liability is a concept in law that generally comes into play in personal injury or wrongful death cases. In a premises liability case, an injury or fatality stems from some kind of defective or unsafe condition on someone else’s property. Most personal injury/wrongful death claims are based on negligence, and premises liability claims are no exception. An injured person, or the surviving family member of a wrongfully deceased individual must be able to prove that the person who owns the property acted negligently with respect to maintenance and/or ownership of the property. In general, negligence in this case is demonstrated by the owner of the property failing to use reasonable care in connection with the property.

A pertinent point in premises liability states that if you were hurt on another person’s property, it  does not necessarily mean that they acted negligently. Further, simply due to the fact that the property may have been in unsafe condition does not instantly mean that the owner of the property was negligent. You must prove that the property owner should have reasonably known that the premises were in unsafe condition and did not take proper steps to fix the situation.

Premises liability cases can be brought for dangerous or unsafe conditions on the premises that result in injury or death as well as inadequate maintenance or defective construction of the premises where the accident/injury/death occurred. Some examples of premises liability cases include the following:

  • Broken railings
  • Open holes on the property
  • Defective equipment
  • Lead poisoning
  • Overgrown/uncontrolled landscaping/tree growth
  • Improperly maintained equipment, furnishings, or furniture
  • Toxic chemical exposure
  • Dog bites/attacks
  • Unmarked/broken steps
  • And more.

In cases where an individual loses their life due to premises liability, a wrongful death attorney in Michigan will know the most effective ways to help their family members move on financially. Although finances are probably the last thing on your mind, if you have recently lost a loved one in this manner, you are probably faced with mounting costs associated with their death.
