If there is a possible or perceived danger affiliated with the product, a redesign that does not compromise its function is necessary. If the product is unable to be redesigned, then safeguards must be established. If the danger cannot be negated with the addition of safety measures or a redesign, then the manufacturer has a duty of care to furnish adequate warnings that alert the user to the possible risks.
When a product could potentially harm a consumer, it is essential that manufacturers notify the public. If businesses are negligent in warning their customers, and deliberately sell products that could seriously injure or kill those who use them, they can and should be held liable.
